Direct Services does not offer products or services to consumers (B2C) on its website, rather, Direct Services offers services to businesses (B2B). Consequently, the Direct Services website in intended for visitors from businesses seeking to learn more about its areas of expertise, services and offerings. Visitors to the Direct Services website are anticipated to be a representative of a 'legal entity' (representing a business) and not a 'data subject' (an individual).

To that extent, Direct Services strives to collect, use, and disclose personal information in a manner consistent with the laws of the countries in which it does business, but it also has a tradition of upholding the highest ethical standards in its business practices.

Personal information provided to Direct Services is done so in the capacity of a B2B (business to business) relationship for validation and login to the client user interface. This may include your name, address, telephone number and e-mail address. Such information will not be released, sold or rented to any entities or individuals outside of Direct Services or authorized Direct Services partners and resellers. Direct Services, or one of its authorized partners or resellers, may contact you in regards to Direct Services products or related services.

Direct Services also collects and analyzes visitor information as part of its standard website activity logging process. This information includes the host domain of the visitor, the pages accessed, the time spent on our site and general browser statistics. This data enables us to become more familiar with the types of users who visit our site, how often they visit and what parts of the site they visit most often. Direct Services uses this information to improve its User Interface, detect/resolve technical issues, and used for account login and validation.

General Data Protection Regulations (GDPR) is a law that was adopted by the European Parliament in April 2016 and is enforceable as of May 25, 2018. The regulation applies to the collection, processing and movement of personal data for individuals residing in 32 European States listed below;

Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Republic of Cyprus, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland and the United Kingdom.

While remaining in full compliance with the applicable, United States laws and regulations, Direct Services Inc. supports GDPR efforts to protect the privacy and data security of the EU citizens as they are residing in their subscribing country. To that extent, efforts are made to monitor and identify the data of EU citizens, isolating those records for exclusions from the database, and/or other special consideration and treatment.

Direct Services intends that its corporate privacy policy and standard practices and procedures will ensure timely compliance with applicable local and international laws and regulations. Direct Services reserves the right to share an individual's information as required by law or to duly authorized information requests of government authorities.

EU-US Privacy Shield

In connection with Direct Services’ processing of personal data it receives from the EU (“EU Data”), Direct Services adheres to the EU-U.S. Privacy Shield Framework Principles issued by the U.S. Department of Commerce (the “Principles”). For more information about the Principles, please visit the Department of Commerce’s Privacy Shield website.

Please direct any inquiries or complaints regarding our compliance with the Principles to the point of contact listed in the “Contact Information” section below. If we do not resolve your complaint, you may submit your complaint free of charge to JAMS using this link: https://www.jamsadr.com/eu-us-privacy-shield, Direct Services’ designated Privacy Shield dispute resolution provider. Under certain conditions specified by the Principles, you may also be able to invoke binding arbitration to resolve your complaint. Direct Services is subject to the investigatory and enforcement powers of the FTC. If Direct Services shares EU data with a third-party service provider that processes the data solely on Direct Services’ behalf, then Company will be liable for that third party’s processing of EU Data in violation of the Principles, unless can prove that it is not responsible for the event giving rise to the damage.

Direct Services does not itself collect personal data, but receives data from its clients who have themselves collected it and who are the data’s controllers. Direct Services then maintains and processes such data in accordance with the wishes of its customers, the data controllers, so the data is in a form suitable for their purposes, generally related to marketing activities or other lawful purposes described by the data controller.

Data processed consists primarily of consumer name, business company name, individual name and address data and limited demographic or lifestyle data. The data controller provides all data. Direct Services does not process EU human resource data.

Direct Services provides direct marketing data processing services designed to help companies and organizations improve their marketing strategies and programs. These services at times may involve third parties for data processing services which Direct Services does not itself conduct. When providing data processing services to Direct Services' clients, we process information per the terms and conditions of the contract set forth by the clients, and disclose third party vendors that may be used. The data is retained for the length of the business relationship with the client, unless instructed otherwise, or dictated by law or legal requirements.

Direct Services relies upon the instructions of its clients (controllers) with respect to the use restriction of marketing information. In normal course, the clients of Direct Services will identify their customers communication preferences, and/or opt-in/opt-out choices.

Direct Services, acting as an “agent” to perform tasks on behalf of and under the instructions of the data controller, is not empowered to delete any data entrusted to it by any person other than the controller or appropriate government authorities vested with authority to require this.

Access: The Privacy Shield Framework Principles, issued by the U.S. Department of Commerce, require that Individuals must have access to personal information about them that an organization holds and be able to correct, amend, or delete that information where it is inaccurate, or has been processed in violation of the Principles, except where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question, or where the rights of persons other than the individual would be violated. Direct Services, acting as an “agent” to perform tasks on behalf of and under the instructions of the data controller, shall forward all data access requests directly to the supplier of the data.

Choice: The Privacy Shield Framework Principles, issued by the U.S. Department of Commerce, requires that an organization must offer individuals the opportunity to choose (opt out) whether their personal information is (i) to be disclosed to a third party or (ii) to be used for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized by the individuals. Individuals must be provided with clear, conspicuous, and readily available mechanisms to exercise choice. Direct Services, acting as an “agent” to perform tasks on behalf of and under the instructions of the data controller, shall forward all opt out requests directly to the supplier of the data.

Direct Services does not knowlingly collect or process data concerning the personal information of children under the age of 16 years, without being provide explicit consent from the data controller who has provided the data for processing.

With regard to data used for marketing purposes: where data is collected for the purposes of direct marketing, effective procedures by the data controller should exist allowing the data subject at any time to “opt-out” from having his data used for such purposes. An individual objecting to such use should contact the controller responsible.
